I doubt it's possible with ATC given that they use an FXCM raw spread and are technically STP not ECN.

The exemption is for $50k or less, though your question is still applicable in the reverse (if said account is <$50 then grows to >$50k). Presumably the rules would simply kick-in once that threshold is crossed.
